1. TERMS & CONDITIONS: This document is issued by ICONIC GLOBAL SPORTS S.L., a company duly registered under the laws of Spain with Company Registration Number B-13988977, and operating under the trade name "Iconic Football Academy". The principal place of business is Avenida De Andalucía, 9, Benahavís 29679, Málaga, Spain. ICONIC GLOBAL SPORTS S.L. is committed to delivering premier programmes in football training and education programmes, along with a comprehensive range of services, upholding the highest standards of quality and professionalism. By engaging in the services provided and registering for any of the Academy’s programmes - whether delivered independently or in partnership with other organisations - the Player and their parent/guardian (if the Player is under the age of 18) agree to comply with, and be bound by, these Terms and Conditions, as well as the Academy’s policies and compliance documents. These documents are accessible via the footer of the Academy’s website and on the Policies and Compliance page at www.iconicfootballacademy.com. Submission of the registration form constitutes acceptance of these Terms and Conditions. The Academy adheres to the General Data Protection Regulation (GDPR) and all applicable data protection laws, ensuring the secure handling of all personal data provided during registration. For the avoidance of doubt, references to data protection law in these Terms refer to the GDPR and applicable Spanish data protection law (including LOPDGDD), unless stated otherwise.
1.1 ACCURACY OF INFORMATION: The Player confirms that all information provided during the registration process, whether through the Academy’s website or registration form, is complete, true, and accurate. Submission of false or incomplete information may result in disqualification from the programme or termination of enrolment without refund.
1.2 ROLE AS AN AMBASSADOR: The Player, as an ambassador of Iconic Football Academy, commits to upholding the values of the sport by adhering to its rules and regulations. The Player must maintain exemplary discipline and conduct throughout the programme, demonstrating sportsmanship in all games and training sessions. This includes showing respect to opposing teams and treating all players, coaches, and officials with courtesy. The Player must also respect the authority of game officials and appreciate the privilege of using public facilities. Furthermore, the Player is required to regularly attend training and educational sessions. Failure to meet programme requirements, including attendance and conduct, may result in dismissal from the programme, without refund, at the sole discretion of the Academy.
1.3 CONDUCT AND BEHAVIOUR: The Player must refrain from the use of drugs, tobacco, alcohol, and engaging in abusive language. The Player acknowledges and accepts that any breach of the Academy’s rules and regulations may result in dismissal from the programme at their own expense, without a refund. The Player is also required to read, understand, and comply with the Player Code of Conduct, which outlines the behavioural standards expected during their participation in the programme. The Player Code of Conduct is accessible via the Academy’s website and forms a binding part of these Terms and Conditions. 1.3A DISCIPLINARY ACTION / DISMISSAL (NO REFUND; FEES REMAIN PAYABLE) The Player acknowledges that serious misconduct, abusive language, refusal to participate, or breach of the Player Code of Conduct may result in immediate dismissal/termination for cause. Where the Academy terminates participation for cause, no refund will be issued and clause 2.7 (Withdrawal After Commencement/Early Termination - Fees Remain Payable) applies.
1.4 CAREER SUCCESS AND PROFESSIONAL OPPORTUNITIES: The Player understands that while Iconic Football Academy provides high-quality coaching and training, success in a professional football career is influenced by various factors beyond the Academy’s control. The Academy does not guarantee contracts or trials with professional clubs during or after participation in the programme.
1.5 TALENT RECOGNITION: The Player acknowledges that Iconic Football Academy offers numerous opportunities for players to be noticed by clubs and scouts. Further consideration will be given to the most talented players based on their level and performance.
1.6 CLUB INTEREST AND REPRESENTATION: Should a player attract interest from a professional club during their participation in the Iconic Football Academy programme, Iconic Global Sports SL t/a Iconic Football Academy will provide guidance and support throughout the process. In such cases, the Academy may act as an intermediary and assist with contract discussions to ensure the player’s best interests are represented. If formal representation or intermediary services are required (including the negotiation of professional contracts or transfers), a separate agreement will be discussed and agreed upon with the player (and parent/guardian, if applicable), which will outline any commission or intermediary arrangements in accordance with applicable regulations.
1.7 DEFINITIONS (for clauses 2, 5, and 6): Booked Term means the programme period, accommodation period, and/or intake dates stated in the Personalised Payment Schedule (including any agreed extensions or agreed changes confirmed by the Academy in writing). Any start month/date selected during online checkout (including via Stripe) is treated as a preference and must match (or be confirmed by) the Booked Term stated in the Personalised Payment Schedule. Termination for Cause means termination by the Academy due to serious misconduct, abusive language, breach of the Player Code of Conduct, refusal to participate, non-compliance with Academy rules, safeguarding concerns, or any other serious breach of these Terms & Conditions. Dismissal has the same meaning as Termination for Cause.
2. PAYMENT TERMS
2.1 ACCEPTED PAYMENT METHODS: Iconic Football Academy accepts payment for all programme fees, the Reservation Payment, and instalments via cards (including Visa, Mastercard, American Express, and other major credit and debit cards), Apple Pay, Google Pay, Link, MobilePay, Revolut Pay, Klarna (Buy Now, Pay Later), and bank or wire transfer. All card and digital payments are securely processed through our payment partner, Stripe.
2.2 METHOD OF PAYMENT: For applicants who choose to pay by bank or wire transfer, payment instructions will be provided by Iconic Football Academy upon request. Applicants should request bank transfer details at the time of registration or as soon as possible after acceptance. Failure to request bank details does not extend payment deadlines set out in the Personalised Payment Schedule. Applicants are responsible for any currency exchange fees or transfer charges applied by their own bank or payment provider.
2.3 DEFINITION - RESERVATION PAYMENT (EARNED ON RECEIPT): For the purposes of these Terms & Conditions, “Reservation Payment” means the upfront payment required to reserve accommodation and secure a place on a programme, in the amount stated in the Personalised Payment Schedule. The Player acknowledges that, upon acceptance of the Reservation Payment, Iconic Football Academy immediately incurs and/or commits operational, administrative, staffing, accommodation, and third‑party costs and loses the opportunity to offer the reserved place to other applicants. Accordingly, the Reservation Payment is earned on receipt and is a genuine pre‑estimate of the Academy’s minimum losses and costs arising from reservation, administration, and capacity allocation; it is not a penalty. For clarity, the Reservation Payment may appear in Stripe Checkout and on receipts/statements using wording such as “Reservation Payment - Accommodation / Pago de Reserva - Alojamiento” (or substantially similar wording). Where the Player does not require accommodation, the Academy may instead take an upfront ‘Programme Fee – Part Payment’ as an advance payment towards the Programme Fee; such payment is subject to clause 5 (Refund & Credit Policy) in the same way as the Reservation Payment.
2.4 RESERVATION PAYMENT: To secure the Player’s place, a non‑refundable Reservation Payment is required for any Iconic Football Academy programme. The Reservation Payment amount will be stated in the Personalised Payment Schedule (as defined in clause 2.6). The Reservation Payment is an advance payment and will be deducted from the total Programme Fee payable for the Booked Term. If the remaining Programme Fee is not paid by the deadlines specified in the Personalised Payment Schedule, or if the Player chooses not to proceed with the programme by the programme start date in the Personalised Payment Schedule (Booked Term) after paying the Reservation Payment, the Academy will retain the Reservation Payment. Any credit/deferral is governed strictly by clause 5.2. However, if the programme is cancelled for reasons attributable to Iconic Global Sports SL and the Academy cannot offer a suitable alternative start date, the Reservation Payment will be refunded without delay.
2.5 PROGRAMME FEES: Programme fees may change from time to time. The Programme Fee payable by the Player will be the total price for the Player’s Booked Term as stated in the Personalised Payment Schedule. For clarity, changes to Programme Fees apply to future bookings and do not change fees already agreed in an issued Personalised Payment Schedule. Flexible payment plans may be offered. In all cases, all fees must be settled in full prior to the programme’s Commencement in accordance with clause 2.6 and the Personalised Payment Schedule. The Programme Fee may be paid in instalments; any instalment is an advance payment toward the Programme Fee and is deducted from the total Programme Fee. Players under 18 on the programme start date may be subject to additional safeguarding and supervision requirements and/or and additional fee at the discretion of Iconic Football Academy. Any such requirements and/or fee (if applicable) will be specified in the Personalised Payment Schedule.
2.6 PERSONALISED PAYMENT SCHEDULE AND DEADLINES: A non‑refundable Reservation Payment is required to secure a place in any Iconic Football Academy programme. The Reservation Payment amount will be stated in the Personalised Payment Schedule. This payment is deductible from the total Programme Fee. Upon acceptance into any Iconic Football Academy programme, the Player will be provided with a Personalised Payment Schedule (the “Personalised Payment Schedule”) setting out the Programme Fee, the Reservation Payment, any instalments, payment amounts, and due dates applicable to the Player. Delivery and binding effect: The Personalised Payment Schedule may be provided by the Academy through any written channel, including (without limitation) email, WhatsApp/message, the registration form, a written contract, or other written correspondence. The Personalised Payment Schedule forms part of these Terms & Conditions and is the binding payment agreement between the Player and Iconic Football Academy. For the avoidance of doubt, any start month/date selected during online checkout (including via Stripe) is treated as a preference and does not override the Booked Term stated in the Personalised Payment Schedule unless confirmed by the Academy in writing. All payments must be made in accordance with the deadlines specified in the Personalised Payment Schedule. Final balance deadline: Unless otherwise stated in the Personalised Payment Schedule, the Programme Fee must be paid in full no later than 21 days prior to the programme start date. Close‑to‑start bookings: Where the programme start date is within 21 days of acceptance, Iconic Football Academy may require payment of the full Programme Fee immediately in order to confirm the place. Failure to pay the Programme Fee in full by the specified deadlines, or failure to commence the programme on the programme start date stated in the Personalised Payment Schedule (Booked Term), will result in forfeiture of the Reservation Payment. For the avoidance of doubt, the Reservation Payment and any instalments form part of the Programme Fee and are subject to clause 5 (Refund & Credit Policy) and clause 2.7 (Withdrawal After Commencement/Early Termination). The Player and parent/guardian acknowledge that the Personalised Payment Schedule sets the fees payable for the Booked Term and that those fees remain payable in accordance with clause 2.7 and clause 5, including where participation ends early after Commencement. All payments are subject to clause 5 (Refund & Credit Policy), including the Academy's no cash/monetary refund policy and any discretionary credit provisions.
2.7 WITHDRAWAL AFTER COMMENCEMENT/EARLY TERMINATION (FEES REMAIN PAYABLE):
2.7.1 Definition - Commencement: For the purposes of these Terms and Conditions, "Commencement" means the earlier of (a) the programme start date stated in the Personalised Payment Schedule; or (b) the date the Player checks into accommodation, attends any training/session, or otherwise begins to receive any programme-related services (including optional services).
2.7.2 Early termination by the Player: If the Player withdraws, leaves, or otherwise ceases participation after Commencement for any reason (including voluntary departure, change of plans, injury, illness, or any other personal circumstances), this constitutes an early termination by the Player. For the avoidance of doubt, early termination also includes where the Player is dismissed or their participation is terminated by the Academy for cause (including serious misconduct, abusive language, refusal to participate, or breach the Player Code of Conduct).
2.7.3 Fees remain payable / acceleration: In the event of early termination, the Player remains liable for the full programme price for the booked programme term (the "Booked Term") as set out in the Personalised Payment Schedule. For the avoidance of doubt:
(a) all payments already made remain non-refundable; and
(b) any unpaid instalments and/or remaining balance for the booked programme term (Booked Term) become immediately due and payable upon early termination, unless the Academy agrees otherwise in writing.
2.7.4 No reduction for non-attendance: Early termination does not reduce or cancel the Player's payment obligations. The Player acknowledges that the Academy commits costs and capacity in advance (including accommodation, staffing, facilities, administration, and third-party services) and may be unable to resell the place at short notice. This applies whether the Player is absent, chooses not to attend, refuses to participate, or is dismissed for misconduct.
2.7.5 Optional services and third-party costs: Where optional services (including meal plans) or third-party services have been ordered, scheduled, or provided for the Player, the Player remains liable for the associated charges for the applicable period and any non-cancellable supplier costs incurred by the Academy.
2.7.6 Recovery: The Academy may issue invoices and/or payment links for any outstanding sums and may pursue recovery of unpaid amounts in accordance with these Terms & Conditions and applicable law. Any discretionary credit, deferral, or accommodation offered by the Academy does not waive the Academy's right to recover outstanding sums unless expressly agreed in writing.
3. TRAVEL, ARRIVAL AND ADDITIONAL COSTS:
3.1 ARRIVAL AND TRANSFER ARRANGEMENTS (STANDARD MEETING POINT; AIRPORT TRANSFERS BY EXCEPTION ONLY):
Standard arrival point: The Academy's standard arrival meeting point is Estepona Central bus station. Collection from this location is arranged as part of onboarding instructions.
Airport transfers (not standard): The Academy does not provide airport collection or drop-off as a standard service. Any airport transfer is provided only by exception, must be expressly agreed by the Academy in writing in advance, and may be subject to an additional charge and availability.
Player responsibility: Unless an airport transfer is expressly agreed in writing, Players (and, where applicable, parents/legal guardians) are responsible for arranging and paying for travel to the standard arrival point, including flights, taxis, private transfers and bus/coach tickets.
Travel details: Players must provide their arrival details in advance in accordance with the Academy's onboarding instructions.
3.2 DELAYED FLIGHTS / TRAVEL DISRUPTION: Iconic Football Academy is not liable for any inconvenience or expenses resulting from flight delays or other travel disruption. While the Academy may assist Players with re-ticketing, booking subsequent travel, and arranging overnight accommodation where reasonably possible, all associated costs remain the responsibility of the Player (and/or parent/legal guardian where applicable).
3.3 LIABILITY FOR PROPERTY DAMAGE: The Player (and/or parent/legal guardian where applicable) will be held accountable for any physical damage caused by the Player. This includes damage to property at accommodation, educational institutions, training facilities, or any property belonging to another Player, staff member, or any other person associated with the programme.
3.4 LOST OR STOLEN PROPERTY: Iconic Football Academy assumes no responsibility for any inconvenience or expenses arising from lost or stolen property. Players are responsible for their own belongings and valuables. Iconic Football Academy will assist Players by notifying local authorities and supporting the filing of a lost or stolen property report where requested.
4. LETTER OF INVITATION (LOI), VISA NON-COMPLIANCE, OR CANCELLATION POLICY
4.1 TRAVEL DOCUMENTATION: It is the exclusive responsibility of the Player and the parent/guardian (if the Player is under 18) to obtain any necessary passports, visas, or other travel documents required for participation in the Programme. The Player and parent/guardian (if the Player is under 18) should retain copies of all travel documents in case of emergencies.
Regardless of citizenship status, the Player and parent/guardian agree to release Iconic Football Academy from liability should they be unable to secure the necessary documentation for programme participation.
4.2 VISA NON-COMPLIANCE: It is the Player’s responsibility (and the responsibility of the parent/guardian if the Player is under 18) to obtain and maintain any visa, residency permission, or other immigration permission required to travel to and participate in the programme. If a visa application is refused, delayed, cancelled, or otherwise not granted in time for the programme start date, this does not entitle the Player to a refund of any fees already paid, including the Reservation Payment, instalments, or programme fees. Any credit, transfer to a future start date, or rebooking option in the event of visa refusal or delay remains at the Academy’s sole discretion, subject to availability and clause 5 (Refund & Credit Policy).
4.3 LETTER OF INVITATION (LOI): If required, the Academy may issue a Letter of Invitation (LOI) in writing, signed by an authorised representative of Iconic Global Sports SL t/a Iconic Football Academy, to support the Player's visa/immigration application once the Player has met the eligibility and payment conditions stated in the Personalised Payment Schedule. For the avoidance of doubt, the applicable payment condition may be payment of the Reservation Payment, payment in full, or another payment requirement stated in the Personalised Payment Schedule. The Academy will only begin LOI-related work once that applicable payment condition has been met. For the purposes of these Terms, the LOI process is deemed to have been initiated once the Academy has (a) drafted the LOI and/or requested supporting documents for the LOI; and/or (b) issued/sent the LOI (or any LOI draft) to the Player or their representative; and/or (c) contacted any third party in connection with the LOI; and/or (d) incurred related third-party or administrative costs (including non‑recoverable affiliate/referral commissions). If the Player cancels their application after the LOI process has been initiated, (a) any Programme Fee payments already made (including any Reservation Payment, part payments/instalments, final balance payments, or full Programme Fee payments) remain subject to clause 5 (Refund & Credit Policy), and (b) the Player will additionally be liable for an LOI/cancellation administration fee (a genuine pre‑estimate of the Academy’s administrative and third‑party costs incurred and/or committed, including any non‑recoverable affiliate/referral commissions) as follows (based on the total programme price): (1) Programme price up to €1,500: €200; (2) Programme price €1,501 to €3,000: €700; (3) Programme price over €3,000: €900 (fee capped). The Academy may invoice this LOI/cancellation administration fee and it is payable immediately upon issue. For clarity, this LOI/cancellation administration fee applies only where the Player cancels after the LOI process has been initiated; it does not apply where the Academy agrees a transfer/deferral under clause 5.2 and the Player proceeds with the programme at a later intake.
5. REFUND & CREDIT POLICY:
5.1 RESERVATION PAYMENT, INSTALMENTS, AND PROGRAMME PAYMENTS: Due to the limited availability of spaces and advance operational commitments (including accommodation and third‑party costs), Iconic Football Academy operates a no monetary refund policy for participant cancellations or withdrawals. No monetary refunds are provided for missed time, holidays/vacation, voluntary absences, or early departure after Commencement. This applies whether the Programme Fee is paid by Reservation Payment plus balance, by instalments/part payments, or in full in advance. All payments, including the Reservation Payment and any 'Programme Fee - Part Payment', and any Programme Fee payments (including instalments, part payments, final balance payments, and full Programme Fee payments made in advance), are non‑refundable once paid, except where Iconic Global Sports SL cancels the programme and cannot offer a suitable alternative start date (see clause 5.3), or where a refund is required by law. Where appropriate, the Academy may offer credit strictly in accordance with clause 5.2. For the avoidance of doubt, no refunds are issued where a Player is dismissed or participation is terminated for cause, or where the Player withdraws/refuses to participate after Commencement.
5.2 CREDIT / TRANSFER TO A FUTURE START DATE: Where a participant cannot attend for a legitimate reason and provides sufficient notice: examples of legitimate reasons may include visa delay/refusal, serious illness/injury, or other circumstances supported by reasonable evidence; however, eligibility is assessed case-by-case. Iconic Football Academy may, at its sole discretion, offer a non-transferable credit to a future start date within 3 months of the original intake, subject to availability. Only one deferral is permitted. Credits are applied to the programme fee at the time of rebooking; if programme fees have changed, the participant will be required to pay any difference. Requests made within 21 days of the programme start date are less likely to be eligible for credit due to accommodation and third-party costs committed in advance. If the next available intake is outside the 3-month window due to academy closure or scheduling, the Academy may, at its sole discretion, permit a later deferral. In such cases, any increase in programme fees must be paid by the participant before commencement. Failure to commence the programme within the permitted period, or further deferrals beyond the one allowed, will result in forfeiture of the Reservation Payment and any credit granted. For the avoidance of doubt, the Reservation Payment is non-refundable and will be forfeited if the participant fails to commence the programme within the permitted period.
5.3 CANCELLATION BY ICONIC GLOBAL SPORTS SL: Iconic Global Sports SL (the registered company operating Iconic Football Academy) reserves the right to cancel or reschedule a programme due to unforeseen circumstances. In such cases, the Academy will make reasonable efforts to offer the Player a suitable alternative start date or programme option operated by the Academy. Where no suitable alternative is available, the Academy will refund all payments made by the Player (including the Reservation Payment and any Programme Fee payments) without undue delay. The Academy’s liability in the event of cancellation is limited to the refund of payments made and excludes any further compensation or damages.
6. PROGRAMME MODIFICATIONS AND THIRD-PARTY SERVICES
Iconic Global Sports SL (the registered company operating Iconic Football Academy) reserves the right to modify or cancel any programme due to unforeseen circumstances such as natural disasters or other events beyond the Academy’s control. In the event of a modification, the Academy will make reasonable efforts to provide equivalent alternatives and will notify the Player and the parent/guardian (if applicable) as soon as possible. Where a programme is cancelled by Iconic Global Sports SL, the Academy will make reasonable efforts to offer a suitable alternative start date or programme option. Where no suitable alternative is available, refunds (if any) will be handled strictly in accordance with clause 5.3 and any refunds required by law.
6.1 THIRD-PARTY SERVICES AND PROVIDERS: Certain elements of the programme may be delivered by third parties (for example, language tuition providers, accommodation providers, transport providers, facility operators, or partner academies). Iconic Football Academy is not liable for the cancellation or material change of services by third parties. Where a third-party service is cancelled or materially changed, the Academy will use reasonable efforts to provide a suitable alternative of broadly equivalent standard and value. Such third-party cancellations or changes do not entitle the Player to a refund of programme fees, except where required by law or where the Academy is unable to provide a reasonable alternative. Where any part of the programme is delivered by third-party partners or academies, including those who may collect payments directly from the Player, Iconic Football Academy acts solely as a facilitator and is not responsible for the delivery, financial transactions, or refund obligations of such third parties.
6.2 TIMETABLE AND SCHEDULING ADJUSTMENTS: The weekly timetable and any written programmes provided by Iconic Football Academy are subject to change. While the Academy strives to maintain the schedule as planned, unforeseen circumstances may necessitate adjustments to training sessions, academic schedules, or other activities. Iconic Football Academy reserves the right to modify the timetable as needed to ensure the highest quality of training and education for Players. Players will be notified of any significant changes in advance whenever possible.
6.3 PARTICIPATION IN OFF-SITE ACTIVITIES AND EXCURSIONS: By enrolling in Iconic Football Academy, the Player and their parent/guardian (if the Player is under the age of 18) consent to the Player’s participation in all academy-supervised activities, outings, and excursions that form part of the regular programme. This includes, but is not limited to, local trips, shopping excursions, cultural visits, training at various venues, and other routine off-site activities. The Academy will ensure appropriate supervision and safeguarding measures are in place for all activities. Separate written consent will be requested for any exceptional or non-routine activities, such as overnight trips or activities not considered part of the standard programme.
6.4 ARRIVAL AND DEPARTURE TRANSFERS: The Academy is not responsible for organising or covering the costs of the Player’s travel to and from the programme, including arrival and departure transfers at the beginning and end of the programme or any term/period of attendance. Any travel arrangements and associated expenses are the sole responsibility of the Player and/or their parent/guardian. For the avoidance of doubt, the Academy's standard arrival meeting point is Estepona central bus station (see clause 3.1). Any airport transfer is provided only by exception where expressly agreed by the Academy in writing in advance (see clause 3.1).
7. MEDICAL DISCLAIMER
7.1 MEDICAL FITNESS: The Player confirms they are in good health and physically fit to participate in Iconic Football Academy programmes. It is recommended to consult a healthcare professional before starting any training.
7.2 MEDICAL INFORMATION: The Player and their parent/guardian (if the Player is under 18), must disclose any relevant medical conditions or treatments that may affect their participation.
7.3 PLAYER MEDICAL FORM:
The Player and their parent/guardian (if the Player is under 18) must complete and submit the Player Medical Form as part of the application and registration process. Failure to do so may result in disqualification from participation. The Player and their parent/guardian (if the Player is under 18) must promptly notify the Academy in writing of any changes to medical information prior to arrival and during the programme.
7.4 INJURY AND LIABILITY WAIVER: The Player and their parent/guardian (if the Player is under the age of 18) acknowledge that participation in Iconic Football Academy programmes involves inherent risks, including but not limited to physical injuries or illnesses. By enrolling, they agree to release, waive, and discharge Iconic Football Academy, its officers, employees, agents, and representatives from all liabilities, claims, demands, or actions arising from any loss, damage, or injury, including death, that may occur as a result of participation. This clause applies only to the maximum extent permitted by applicable law and does not exclude or limit liability where such exclusion or limitation is not permitted by law.
7.5 EMERGENCY MEDICAL CARE: In the event of a medical emergency, Iconic Football Academy will make every reasonable effort to contact the Player’s emergency contact. However, the Player and their parent/guardian (if the Player is under 18), consent to necessary medical treatment, including transportation, as deemed essential by Academy staff. The Player and their parent/guardian (if the Player is under 18) accept full responsibility for all associated costs. They also acknowledge that the Academy’s medical insurance policy, if any, provides only minimum coverage, and they are required to secure adequate travel medical insurance.
7.6 LIABILITY WAIVER: By enrolling, the Player and their parent/guardian (if the Player is under the age of 18) release Iconic Football Academy, its officers, staff, agents, and representatives from any liability for injuries, illnesses, or health issues that may arise during the Player’s participation in the programme.
7.7 PRIVACY AND PROTECTION: All medical information provided will be treated confidentially and used solely to ensure the Player’s safety and well-being. Iconic Football Academy processes this data in compliance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection law (including LOPDGDD). For more details on how personal data is collected, processed, and stored, please refer to the Player Privacy Notice, available at www.iconicfootballacademy.com.
7.8 AGREEMENT TO TERMS: By registering, the Player and their parent/guardian confirm they have read, understood, and agree to this medical disclaimer.
8. INSURANCE AND INJURIES
8.1 INSURANCE REQUIREMENTS: Iconic Football Academy maintains general liability and accident insurance for incidents occurring during official programme activities and within its facilities. However, this insurance does not cover players outside scheduled activities or offsite. The Player, or their parent/guardian (if under 18), is required to secure comprehensive personal insurance including both travel and medical coverage from a provider recognised in Spain. This insurance must cover the entire duration of the Player’s stay, including periods outside the programme, and must meet Spanish immigration requirements for international students (where applicable). As part of our safeguarding and compliance procedures, all participants regardless of the duration of their programme or event (including short stays, camps, and trial days) must provide proof of valid travel health insurance covering medical emergencies, accidents, and repatriation for the full duration of their stay in Spain. Insurance documentation must clearly state the policy number and provide emergency contact information for the insurer. Proof of insurance must be sent to info@iconicfootballacademy.com at least two weeks before arrival. Failure to provide proof may result in denial of participation. If you have questions about acceptable coverage, please contact us. The Academy strongly recommends comprehensive medical assistance insurance, especially for non-EU Players. Iconic Football Academy assumes no responsibility or liability for any costs, losses, or claims arising from incidents not covered by the Academy’s own insurance policy.
8.2 PLAYER INJURIES: The Academy is not responsible for injuries incurred during programmes, including those related to football activities. Injuries do not warrant refunds, as programme costs (e.g., accommodation, meals, transportation) remain fixed. Players exiting the programme due to injury are responsible for arranging and covering their own transportation costs. Future enrolments may qualify for discounts or credits at the Academy’s discretion. Players are responsible for ensuring their insurance covers all football-related activities and must ensure that their health insurance which may be included as part of a travel insurance policy covers medical treatment, illness, and accidents for the entire duration of the programme.
8.3 INCIDENTS OUTSIDE THE PROGRAMME: The Academy is not liable for incidents occurring outside its supervision. Players must obtain staff authorisation before engaging in external activities. For Players under the age of 18, a signed Parental Permission Release Form is required to absolve the Academy of liability. Departures without proper consent are undertaken at the Player’s own risk. The Academy’s duty of care applies only during scheduled and supervised activities.
9. PHOTO AND VIDEO RELEASE CONSENT
9.1 CONSENT TO USE OF IMAGES: The Player and their parent/guardian (if under the age of 18) consent to the collection and use of photographs and videos by Iconic Football Academy for promotional, marketing, and educational purposes. This includes, but is not limited to, use on social media, the Academy’s website, brochures, and other advertising materials.
9.2 COMPENSATION: The Player acknowledges that no financial compensation will be provided for the use of these images or videos.
9.3 RIGHTS WAIVER: The Player waives any right to inspect or approve the finished product, including written content, created in connection with their images or videos.
9.4 CONSENT DURATION AND WITHDRAWAL: This consent is valid for as long as necessary for the stated purposes. However, the Player and their parent/guardian (if under 18) may withdraw consent at any time by providing written notice to privacy@iconicfootballacademy.com. Upon receipt, the Academy will cease using the Player’s photographs or videos for future promotional purposes. For clarity, withdrawal does not require the Academy to remove content already printed or already published where removal is not reasonably practicable; however, the Academy will make reasonable efforts to remove/stop using content going forward.
9.5 DATA PROTECTION COMPLIANCE: All personal data, including images and videos, will be processed in compliance with applicable data protection laws, including GDPR and the Academy’s Privacy Policy. Data will be handled securely to protect the Player’s privacy.
9.6 LEGAL AUTHORITY: The Player confirms they are of legal age to provide this consent, or the parent/guardian confirms they are the legal guardian and have the authority to grant such consent.
10. GDPR COMPLIANCE: Iconic Football Academy collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection law (including LOPDGDD). Personal data, including copies of identification documents (e.g., passports), is collected for purposes such as verifying identity, programme administration, legal compliance, and player safety. All personal data is securely stored and accessed only by authorised personnel. Data will not be shared with third parties except as required by law, for visa processing, or as outlined in the Academy’s Privacy Notice and Privacy Policy. For full details on how personal data is collected, processed, and stored, applicants must review the Privacy Notice and Privacy Policy, available at www.iconicfootballacademy.com. By submitting the registration form, the Player (and parent/guardian, if applicable) acknowledges they have read and understood the Privacy Notice and Privacy Policy and acknowledges the processing of personal data as described.
11. POLICIES AND COMPLIANCE DOCUMENTS: By submitting the application or registration form, the Player and their parent/guardian (if the Player is under 18) confirm that they have read, understood, and agreed to the policies and compliance documents of Iconic Football Academy. These documents, including but not limited to the Terms and Conditions, Privacy Policy, and Player Code of Conduct, are available on the Academy’s website at www.iconicfootballacademy.com. Applicants must review these documents thoroughly before completing their registration, as submission constitutes acceptance of all policies.
12. FORCE MAJEURE: Iconic Football Academy is not liable for failure or delays in fulfilling its obligations due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, or governmental restrictions. In such cases, the Academy will make reasonable efforts to resume operations promptly and communicate changes to the Player and their parent/guardian (if applicable). Where possible, the Academy may offer rescheduling and/or credit in accordance with clause 5.2. Any monetary refunds will be provided only where required by law or where clause 5.3 applies (cancellation with no suitable alternative).
13. GOVERNING LAW AND JURISDICTION: These Terms and Conditions are governed by the laws of Spain. Any disputes arising from or related to these Terms and Conditions shall fall under the exclusive jurisdiction of the courts in Málaga, Spain. The Player and their parent/guardian (if applicable) agree to submit to the jurisdiction of these courts for dispute resolution.
14. COMPLIANCE OFFICER: The Academy’s Compliance Officer is appointed by Iconic Global Sports SL and is responsible for ensuring adherence to legal standards and internal policies. The Compliance Officer's responsibilities include developing compliance programmes, conducting audits, and liaising with regulatory bodies to ensure compliance with applicable laws. Compliance enquiries should be sent to info@iconicfootballacademy.com. Iconic Global Sports SL reserves the right to appoint and replace the Compliance Officer from time to time.
15. DATA PROTECTION LEAD (PRIVACY CONTACT): The Academy’s Data Protection Lead is appointed by Iconic Global Sports SL and oversees data protection practices and supports compliance with the GDPR and applicable Spanish data protection law (including LOPDGDD). The Data Protection Lead's responsibilities include maintaining data protection policies and procedures, supporting GDPR compliance, coordinating responses to data subject requests, and providing guidance on data handling practices. Data protection enquiries (including GDPR requests) should be sent to privacy@iconicfootballacademy.com. Iconic Global Sports SL may update the appointed Data Protection Lead from time to time.
